What is PTEC and Who Needs It?
he Professional Tax Enrollment Certificate is mandated by the Profession Tax Act, of 1975. As per the Act, PTEC registration and professional tax payment is compulsory for all incorporated companies, LLPs, partnerships firms, and working professionals in the private and public sectors across India. Specifically, legal practitioners, medical professionals like doctors and consultants, chartered accountants, tax consultants, technical experts like engineers and architects, advertising professionals, insurance agents, stock brokers, real estate brokers, commission agents, contractors, gas dealers, textile dealers, timber merchants, and more are required by law to acquire a PTEC. The professional tax applies to both individuals earning income from profession, trade, or employment as well as companies registered under the Companies Act, 2013 that are involved in any kind of business activity or profession. Some exceptions for PTEC applicability apply to individuals above 65 years of age.

Newly incorporated companies must enroll for the PTEC certificate within 30 days of receiving the certificate of incorporation from MCA. Similarly, professionals should apply for PTEC within 30 days of starting their practice. For registered businesses, it is mandatory to file annual PTEC returns within the prescribed due dates. Failing to obtain PTEC registration or meet compliance timelines can attract penalties under Section 8 of the Profession Tax Act. Therefore, meeting PTEC deadlines is essential.
